Lasting Power of Attorney

A Lasting Power of Attorney (LPA)(previously known as an Enduring Power of Attorney) is a legal document that allows you to appoint one or more trusted people (known as attorneys) to make decisions on your behalf if you are unable to do so yourself, either temporarily or permanently. It is an important part of forward planning and only takes effect if you lose mental capacity, or earlier if you choose, depending on the type of LPA.

There are two main types of LPA:

  • Property and Financial Affairs LPA, which covers matters such as managing bank accounts, paying bills, handling property, and managing investments.

  • Health and Welfare LPA, which covers decisions about medical treatment, care arrangements, and daily living, and only comes into effect if you lack capacity.

Most of our services are provided on a fixed-fee basis to keep prices as simple as possible. For non-fixed-fee work, we charge based on the time spent on your matter in accordance with our hourly rates applicable at the time. Depending on the service you select, your case will be managed by our solicitors, case managers, and paralegals and supported by our administrators. Each case is allocated to the most appropriate team member, all of whom have many years of experience. From the outset, it will be made clear who your primary contact will be.

 

All appointments can be sat via telephone or virtually to suit you. We offer services in multiple languages, including Punjabi, Hindi, and Urdu. If you have hearing loss or a speech impediment, we are happy to take instructions via Relay UK. We welcome all customers and will do our best to accommodate any additional needs you may have.

 

Stated time frames are based on our receiving full, clear and substantiated instructions. Delays may occur if we need to clarify or review the information we have been given.

All online services can be completed at your own pace. We recommend allowing at least 45 minutes to 1 hour to complete the online documents. Once the online form has been filled out, you can print your Will or LPA immediately. With LPA, the documents must be sent to the OPG to be registered. Once complete, we recommend that you safely store your LPA and inform the relevant parties of its existence.

The work that may be involved in putting an LPA in place:

  • At the appointment, you will decide which type of LPA is required, choose and appoint attorney(s), define powers, preferences, and restrictions, select a certificate provider. 1–3 days

  • We will draft and send a copy of the LPA within 10 working days

  • You will then sign and date the LPA in the correct order. We are on hand to help with this stage if you have any queries. 5 - 10 working days

  • Notify relevant people (if applicable). 5 - 10 working days

  • Submit the LPA for registration within 5 working days of receiving a correctly signed document. If any amendments are needed, we will draft and send another copy within the time frame above.

  • Registration by the Office of the Public Guardian. 8–12 weeks

  • We will safely store the registered LPA upon receipt of the certified copy.

​Part of our service is to chase any Government agencies, like the OPG, on your behalf, and we aim to get the application approved as quickly as possible, and usually quicker than if a layperson applies.

**Please note, there are certain circumstances in which you may be entitled to an exemption (the registration is free of charge) or a remission (you pay 50% of the fee). Exemptions and remissions are based on your personal circumstances, and you will need to supply proof to the OPG. For example, copies of recent letters (dated within the last three months) confirming receipt of the benefits, such as letters from the Department of Work and Pensions or benefit provider, or proof of gross annual income below £12,000 per year.

  • Remission (50% Reduction): If the donor's gross annual income (before tax) is less than £12,000. 

  • Exemption (No Fee): If the donor receives specific means-tested benefits, such as Income Support or the Income-based Employment and Support Allowance.


Registration fees are paid directly to the OPG by card or cheque. We do not set these prices and are subject to change without notice, as determined by the OPG.

Professional Attorney Services   1.5% of the Gross Value of the Estate + VAT, per annum

A Professional Attorney is a qualified individual or firm appointed under a Lasting Power of Attorney (LPA) to manage the financial, property, or health and welfare affairs of someone who is unable to make decisions for themselves. This can be an alternative where family members are unavailable, unwilling, or lack the expertise to act.

 

Key Stages

  • Initial Consultation and Assessment – 5 working days

  • Ensure the LPA is formally registered - 5 working days

  • Commencement of Professional Attorney Services and begin acting on behalf of the donor - ongoing

Example Fees based on GVE £250,000. 

  • Legal Fees £4,500 (£3,750 + 750 VAT)

There will be other third-party costs in addition to the above. Please note that it is difficult to provide an exact estimate of costs, as they will vary depending on the specific circumstances and the composition of the estate. The disbursements are as follows:

  • Capacity assessment fees – typically £600 (£500 + £100 VAT) for a single assessment by a medical professional

  • Court fees – applicable if Court of Protection involvement is required, varying by application type

  • Postage, printing, and document handling – usually £30 depending on volume and urgency.

  • Travel or specialist consultations – typically £120 (£100 + £20 VAT) per visit or assessment
